Business Account

The following Terms & Conditions are the only binding conditions in this contract between Venezzo AG, CH-8304 Wallisellen ("M123") and the client ("Advertiser").

1. "Massage 123" is an online portal to advertise erotic massages, wellness and tantra services. It is intended for an adult audience only that is 18 years or older. The advertiser is obligated to offer its services only to persons that are 18 years or older.
2. By placing ads or booking promotional actions the parties enter a service contract. M123 is obligated to publish ads and promotions during the booked period on the appropriate country site of "Massage 123". By creating advertisements and commercials, the customer consents to publication on the portal as well as any other communication or publication channels of M123.
3. The advertiser is obligated to make truthful descriptions about the offered services and to fulfill them accordingly by respecting current laws.
4. Only one account may be created per customer.
5. Personal information about the advertiser is kept confidential and will not be shared with third parties nor published. M123 is however entitled to check information provided by customers or have it checked by third parties, even retrospectively, and to request additional information from advertisers.
6. The advertiser is responsible to posses the necessary copyrights of texts and pictures used in advertisments. By publishing advertisements, M123 does not make any text or pictures its own. M123 has the right to block or delete pictures in case of an obvious copyright infringement. Any copyright claims from third parties including all connected costs are at the expense of the advertiser. M123 is also entitled to adapt texts at its own discretion and without consultation, for example in the event of a breach of the advertising rules or to improve readability.
7. There is no entitlement to have ads, banners or other marketing material to appear on a certain position on the "Massage 123" platform except when it's part of an offering.
8. Ads must have a focus on massages/tantra, must not be insulting and shall not contain illegal content or offerings that violate local laws. M123 reserves the right to decline ads without further explanation.
9. By buying advertising credit, the advertiser buys the right to use the respective amount for placing advertisments and booking promotions or using services. It is no cash balance and therefore cannot be paid back. There is also no reimbursement in case the advertiser decides to terminate a promotion, cancel an ad or no longer offer his/her services. Advertising credit expires when not used after a period of 2 years, counted from the date of the last login.
10. To charge the business account it is only allowed to use a means of payment that belongs to the advertiser.
11. In case of violation of these terms, M123 reserves the right to immediately terminate advertisments or promotions without refund or in severe cases, suspend a business account.
12. Aside from the technical facts of the internet we cannot guarantee one hundred percent availability of this service although we make every effort to keep the service available at any time. Any warranty or liabilty in this connection is - as far as legally permissible - waived. Any refund-claims are therefore excluded.
13. This contract is subject to Swiss law. Place of jurisdiction is Zürich, Switzerland.

Anonymous data collection
You can visit our website without leaving any personal information. We do not store any personal data in this context. In order to improve our offer, we only evaluate statistical data which do not allow any conclusion to your person.

Data collection and processing
When using the contact form it is necessary to enter an email address, this is necessary to be able to process an inquiry. The IP address can be logged in anonymous form, out of a legitimate interest to protect against misuse. Enquiries will be deleted after two years, unless archiving obligations provide for a longer period. The placement of advertising and the administration of advertising measures requires the creation of an advertising account. Only data necessary for the fulfilment of this service will be collected. In particular, these are contact data. The data is stored together with the IP address of the computer used for registration. For security reasons, the IP address is also stored when logging in and during administrative and booking activities. This is in the legitimate interest of protection against misuse. Collected data will not be passed on to third parties with the exception of for tax and accounting purposes or if legal obligations require it. The data is stored as long as required by law.

Newsletter
It is possible to subscribe to our newsletter, for this the email address is collected for the purpose of delivery. The Double-Opt-In procedure is used. That means: After registration an email is sent, which must be confirmed again. The time and IP address of the computer used will be logged in order to prove the registration in accordance with the law. You can unsubscribe at any time by clicking on the unsubscribe link in each newsletter, which will also delete all data collected during registration. The data will not be passed on to third parties.

Data Security
The data made available to us is secured by taking all technical and organisational security measures to ensure that it is inaccessible to unauthorised third parties. The use of data encryption (SSL) ensures that no data can be changed or recorded during the Internet connection from the client to the server.

Rights
If personal data has been collected, you have the right to access, correct or adopt it. Furthermore, the deletion or blocking of the data can be requested. However, a request for deletion does not include the data that we are required to keep due to administrative, legal or security-related necessities. We may request appropriate documents (e.g., identification) to verify identity for inquiries and may charge an expense allowance for repeated inquiries. There is the right to contact the local data protection authority in case of disputes.

Cookies
Temporary session cookies are used to measure visitor flows anonymously as well as to store session data after a login, this for legitimate interest to provide the service. Cookies are not shared with or made available to third parties, they do not contain personal data. Every browser offers the option of refusing to accept cookies, but this may restrict the functionality of the website.
